Terms of Service

These Terms of Service ("Terms") form a binding agreement between you (and, if applicable, the company or organization you represent) and eOdessa Interactive LLC ("eOdessa," "we," "us," or "our") governing your access to and use of eodessa.com and the Visible application at visible.eodessa.com (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms.

1. Acceptance of these Terms

By accessing eodessa.com, registering for an account, or using any part of the Service, you confirm that you can form a binding contract with eOdessa, that you accept these Terms, and that you agree to comply with them. If you're accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity, in which case "you" refers to that entity.

If you do not agree to these Terms, do not use the Service. Our Privacy Policy is incorporated into these Terms by reference and describes how we collect and use personal data.

2. The Service

Visible is an AI search visibility platform that tracks how AI assistants — including ChatGPT, Claude, Gemini, Perplexity, Google AI Overview, and Copilot — mention, cite, and rank a brand against tracked competitors, and provides related diagnostic (Deep Scan) and content (FAQ Builder) tooling. The specific features, AI platforms, usage limits, and history windows available to you depend on your subscription plan, as described on our pricing page, which may change from time to time as described in these Terms.

We may add, change, or remove features, and may modify or discontinue the Service (in whole or in part) at any time. Where reasonably possible, we'll provide advance notice of material changes that reduce the functionality of a paid plan you're subscribed to.

3. Accounts, teams & roles

You must provide accurate registration information and keep your login credentials confidential. You're responsible for all activity that occurs under your account, whether or not you authorized it, except to the extent caused by our breach of these Terms.

An account "Admin" may invite teammates as "Moderators" to collaborate on that company's data, subject to the seat limits of the applicable plan. A single person may hold memberships — and different roles — in more than one company at the same time (for example, Admin of their own company and Moderator of a company that invited them), and may switch which company they're acting as within the app. Each company's Admin(s) are responsible for managing that company's team membership and the access level granted to each teammate.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account.

4. Subscription plans, billing & free trials

  • Visible offers a permanent free plan and one or more paid subscription plans, billed monthly in advance unless otherwise stated on the pricing page.
  • New paid signups may receive a free trial of a higher-tier plan (currently 14 days). At the end of the trial, your plan automatically steps down to the free plan unless you add billing information and select a paid plan; we will not charge you at the end of a trial without your affirmative action to subscribe, unless we clearly disclose otherwise at signup.
  • Paid subscriptions automatically renew each billing period at the then-current price for your plan until canceled. We may change plan pricing or features on a going-forward basis; for existing subscribers, we'll provide reasonable advance notice of a price increase before it applies to your next renewal.
  • Payment is processed by a third-party payment processor. You authorize us (via our payment processor) to charge your chosen payment method for all fees incurred. You're responsible for keeping your payment information current.
  • Fees are exclusive of taxes unless stated otherwise; you're responsible for any applicable sales, use, or similar taxes other than taxes on our net income.

5. Cancellation & refunds

You may cancel a paid subscription at any time from your account settings; cancellation takes effect at the end of your current billing period, and you'll retain access to the paid plan's features until then. We do not provide refunds or credits for partial billing periods, except where required by applicable law or at our sole discretion. Downgrading or canceling a plan may reduce your tracked prompts, platforms, history, or team seats to the limits of the new plan.

6. Your content & data

"Your Content" means the brand, competitor, prompt, sitemap, log-file, and other data or files you or your teammates submit to the Service. As between you and eOdessa, you retain all rights to Your Content. You grant eOdessa a worldwide, non-exclusive, royalty-free license to host, copy, transmit, and process Your Content solely as necessary to provide, maintain, and improve the Service for you — including sending relevant portions of Your Content (such as a tracked prompt or a brand/competitor name) to the third-party AI platforms described in Section 7 and our Privacy Policy.

You represent that you have the necessary rights to submit Your Content and that doing so does not violate any third party's rights or any applicable law. We may remove content or suspend access if we reasonably believe it violates these Terms.

7. AI-generated results & third-party AI platforms

The Service's core function depends on querying third-party AI platforms (such as OpenAI's ChatGPT, Anthropic's Claude, Google's Gemini and AI Overview, Perplexity, and Microsoft's Copilot) and reporting, scoring, and classifying their responses. These platforms are operated independently of eOdessa, and:

  • Their responses, availability, output format, and underlying models can change at any time without our control, which may affect your Visibility Score, sentiment classifications, or other metrics;
  • AI-generated content is inherently probabilistic and may be inaccurate, incomplete, or unrepresentative of a broader population of real end-user queries, even when reported faithfully by our Service;
  • Any content we generate to help you respond to visibility gaps (for example, via FAQ Builder) is a drafting aid — you are responsible for reviewing, editing, and approving any such content before publishing it, and for its accuracy and compliance with applicable law.

We do not warrant the accuracy, completeness, or availability of any third-party AI platform's output, or that a given score or recommendation will improve your actual standing with any AI platform.

8. Acceptable use

You agree not to:

  • Use the Service to violate any law, or to infringe or misappropriate any third party's intellectual property or privacy rights;
  • Submit Your Content that is unlawful, defamatory, or that you don't have the right to submit;
  • Attempt to gain unauthorized access to the Service, other users' accounts or data, or our systems;
  • Probe, scan, or test the vulnerability of the Service, or interfere with its normal operation, including via denial-of-service attacks or excessive automated requests outside of documented API/MCP usage;
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service, except to the extent applicable law prohibits this restriction;
  • Resell, sublicense, or provide the Service to third parties as your own competing product without our written consent;
  • Use automated means to scrape or bulk-extract data from the Service beyond what our documented API/MCP access permits.

We may suspend or terminate access for accounts we reasonably believe violate this section, with notice where practicable.

9. Intellectual property

eOdessa and its licensors own all right, title, and interest in and to the Service, including its software, design, text, and the "Visible" and "eOdessa" names and logos, excluding Your Content. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes, subject to your compliance with these Terms. All rights not expressly granted are reserved.

You may not use eOdessa's or Visible's name, logo, or trademarks without our prior written permission, except as necessary to accurately describe that you use the Service.

10. Third-party services & links

The Service may link to, integrate with, or rely on third-party websites, platforms, or services (including the AI platforms referenced in Section 7, payment processing, and authentication infrastructure). We don't control and aren't responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

11. Disclaimer of warranties

As-is, as-available

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY SCORE, RECOMMENDATION, OR AI-GENERATED OUTPUT WILL BE ACCURATE OR ACHIEVE ANY PARTICULAR RESULT. SOME JURISDICTIONS DON'T ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EODESSA AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EODESSA'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100. SOME JURISDICTIONS DON'T ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

You agree to defend, indemnify, and hold harmless eOdessa and its officers, employees, and service providers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content; (b) your use of the Service in violation of these Terms or applicable law; or (c) your violation of a third party's rights.

14. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service if you materially breach these Terms and don't cure the breach within a reasonable period after notice (where practicable), if required by law, or to protect the security or integrity of the Service. Sections that by their nature should survive termination — including Sections 9 (Intellectual Property), 11–14 (Warranties, Liability, Indemnification, and this Termination clause's survival), and 16 (Governing Law) — will survive.

Upon termination, your right to access the Service ends; we will handle any residual account data in line with our Privacy Policy's retention practices.

15. Governing law & dispute resolution

eOdessa Interactive LLC is a limited liability company organized under the laws of the State of California, USA. These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Before filing a claim against eOdessa, you agree to first contact us at visible@eodessa.com and attempt to resolve the dispute informally. Any dispute that can't be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in California, and each party consents to personal jurisdiction and venue there and waives any objection to that venue, except where applicable consumer-protection law gives you the right to bring a claim in your own local courts.

16. Changes to these Terms

We may update these Terms from time to time. We'll update the "Last updated" date above, and for material changes, we'll provide additional notice (such as an in-app notification or email) where required by law or where the change materially reduces your rights. Continuing to use the Service after a change takes effect constitutes acceptance of the updated Terms; if you don't agree, you should stop using the Service and may cancel your subscription as described in Section 5.

17. Miscellaneous

  • Entire agreement — these Terms, together with our Privacy Policy and any order form or plan terms you agree to, constitute the entire agreement between you and eOdessa regarding the Service, superseding prior agreements on the same subject.
  • Severability — if any provision of these Terms is held unenforceable, the remaining provisions will remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
  • No waiver — our failure to enforce a provision isn't a waiver of our right to do so later.
  • Assignment — you may not assign these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Force majeure — neither party is liable for delay or failure to perform caused by events beyond its reasonable control.
  • Notices — we may provide notices to you via email or an in-app notification; you may provide notices to us at the contact address in Section 18.
